so i was given a 78 special, I finally got it running and would like to take it out, but I have a slight situation that may or may not be a big deal.

The guy who gave me the bike just handed me the title, he didnt sign it over or give me a bill of sale..

He also never registered the bike, the title is just signed over to him, so the title is actually still in the name of the owner before him.

So i have a running motorcycle, and a title, but I don't know if I will be able to get it registered..

Also I am in the state of Colorado

Anybody know anything about a situation like this???
let me know...

P.S. this website is so great and I just want to thank everyone for all the good advice i've been getting, I could not have gotten my bike running without it!

I'd check with the Colorado DMV but I would not give my name. Sounds like a bureaucrat is gonna make your life interesting but you never know, it might be simple. I think a bill of sale at the least would be worth having.

on the back of the title it is signed over to the person who gave it to me. It has the buyer and sellers' signatures and says it was sold in 2002 for $575.

However the guy who gave it to me never registered it so the title isn't in his name

snice the guy you got the bike from already sign the title as the buyer, he will have to register the bike to get a new title on his name and then sign the new title over to you....

Here in MO that might be a small issue. There is a penalty of $25 a month for not reassigning the title. On my old XS I didn't realize the PO had dated it and I didn't tag the bike for four months so I was charged $100 penalty..I think there is a max amount of $250 or something here though.

Colorado DMV FAQ

You know why that stuff is under the Dept of Revenue don't you? Here in MO too.
So they can get revenue from US!

I had the same thing here in Iowa signed title, bike went thru a couple different people without being changed had a choice of trying to get original seller to apply for duplicate title and sign over to me or apply for a bonded (abandoned vehicle/lost) title, rather than chase around trying to find some guy who might or might not cooperate I just went with the bonded title

I had the same problem with the bike I have now. I had my insurance agent call a friend at the DMV here in NY. The woman told me just to skip the middle man(the last guy I bought it from who never signed the title) and register it as if had bought it from the first guy,I didn't need a bill of sale I just had to fill out a form and didnt need his signature other than the one on the title.NY is probably one of the toughest states full of BS and red tape, so if I can do it that easily I'm sure you shouldn't have a problem, just make sure you call and don't go in person until you find out the procedure. If you go in person and there's a problem sometimes that will become record, then you have a real big problem. Also i have to laugh at these guys on ebay trying to sell bikes without a title, they tell you it shouldn't be a problem getting a title well if its not why don't they have one? company's like broadway title have stricter guidelines now and I might be mistaking but I think your bike now has to be a 75 or older to get a title in the states that allow it. Never buy a bike you plan on riding without paper work at least here in NY or some of the stricter states unless your paying parts bike prices

so it looks like my best bet might be to go for an abandoned vehicle registration.. The guy who had it before me mentioned that he had some trouble getting it registered and thats why he never did. It hasn't been plated since 2005 so that probably qualifies it as abandoned..right?

How do you go about getting an abandoned vehicle title? I guess I should just call the DMV and find out becaus it is probably quite a bit different state to state...

Ah, DMV by phone. I can hear the music in my brain as I wait on hold for 45 minutes. If you are near the DMV I'd suggest a face to face. Odds are you will get someone who doesn't know how or doesn't care to fix your problem.
